Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Variantmobile application, website, and related services (together, the “Service”), operated by Variant(“Variant,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not Financial Advice

Variant is a media and social platform for finance content. All content on the Service — including AI-generated videos, pitches, research, signals, rankings, and creator commentary — is provided for informational and entertainment purposes only and does not constitute financial, investment, legal, tax, or other professional advice, nor a recommendation, offer, or solicitation to buy or sell any security or asset. Variant is not a broker-dealer, investment adviser, or financial institution. Creators may hold positions in the securities they discuss. Markets involve risk, including the possible loss of principal. You are solely responsible for your own investment decisions and should consult a licensed professional and conduct your own research before acting on any content.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Your Account

You register using your phone number and a one-time verification code. You are responsible for maintaining the security of your device and account and for all activity that occurs under it. One account is permitted per person. Notify us promptly of any unauthorized use.

4. User Content

You retain ownership of the content you submit, including selfies, text, and generated media (“User Content”). You grant Varianta worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, process, publish, and display your User Content for the purpose of operating, providing, and promoting the Service. You represent that you have the rights to your User Content and that it does not infringe any third party’s rights or violate any law.

5. AI-Generated Content & Your Likeness

The Service uses artificial intelligence to generate avatars and videos from the selfie and inputs you provide. You consent to this processing and to the creation of an AI likeness based on your image. AI output may be inaccurate, incomplete, or not reflect real events, and should not be relied upon as fact. You are responsible for the content you choose to generate and publish.

6. Tokens & Payments

The Service uses “tokens,” a virtual, in-app item used to generate content and access certain features. Tokens have no monetary value, are not redeemable for cash, and are non-transferable. Token purchases are processed through the Apple App Store and are subject to Apple’s terms. Except where required by law or the applicable app store’s policies, all purchases are final and non-refundable. We may change token pricing, packages, or generation costs at any time.

7. Acceptable Use

You agree not to: (a) post unlawful, fraudulent, misleading, defamatory, hateful, or infringing content; (b) impersonate any person or use another person’s likeness without permission; (c) manipulate markets, distribute “pump-and-dump,” or promote securities fraud; (d) attempt to access accounts, data, or systems without authorization, or interfere with the Service; (e) scrape, reverse engineer, or misuse the Service or its APIs; or (f) use the Service to violate any applicable law or regulation.

Zero tolerance for objectionable content and abusive users. Variant has no tolerance for objectionable, abusive, or offensive content or behavior. You can report any content or user, and block any user, directly in the app. We review reports and will remove offending content and eject the responsible user, generally within 24 hours. By using the Service you agree to this policy; violations may result in immediate removal and account termination.

8. API & Developer Access

If you access our API or developer tools, you must comply with any applicable rate limits, keep your credentials secure, and use them only as documented. We may suspend or revoke access for misuse.

9. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Variant and protected by applicable laws. These Terms do not grant you any right in our intellectual property except the limited right to use the Service in accordance with these Terms.

10. Moderation & Termination

We may review, remove, or restrict content and may suspend or terminate accounts that violate these Terms or that we deem harmful to the Service or its users, with or without notice. You may stop using the Service and request account deletion at any time.

11. Third-Party Services

The Service relies on third-party providers (for example, for SMS delivery, AI generation, hosting, analytics, and payments). Your use may be subject to their terms, and we are not responsible for third-party services.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate or reliable.

13. Limitation of Liability

To the maximum extent permitted by law, Variant and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or investment losses, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

14. Indemnification

You agree to indemnify and hold Variant harmless from any claims, damages, or expenses arising from your User Content, your use of the Service, or your violation of these Terms or any law.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and may notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
